Heavyweight prospect Dave Herman is currently embroiled in a breach of contract lawsuit against Bellator, but the promotion has made another attempt at reconciliation, offering him a Sept. 9 date against former UFC champion Ricco Rodriguez, MMA Fighting has learned.

I don't see how that can help him.
He should be in heavyweight tournament
Or he gets ricco. And a shot at. Heavyweight champ at later date
Who ever that may be

He'd be willing to fight.. if Bellator pays an additional 50K in Herman's attorney fees.

Didnt the contract state that Herman would be guaranteed 2 fights in 09', but yet only fought once under the Bellator banner that year? And then when Herman fought Frye in Shark Fights - Bellator assigned him that fight to meet contractual obligations - although Shark Fights side of things said that they were not in contact with Bellator. Kind of messy, not sure if would all be worth it.

Sherdog has a piece on the litigation Here .

Always make sure you get things authorized, and in writing - it will definitely help your case. Verbal agreements - or text message agreements are no longer good enough like it was several years ago.

Seems like Hermans loss to Mu-Bae-Choi made everything sour for Bellator? Definitely interested to see how this plays out.
